TICKETING TERMS AND CONDITIONS
1.1 These Terms and Conditions are a legally binding contract between you and Fourth Floor Creative Limited (incorporated and registered in England and Wales with company number 11060430) Fourth Floor, King William House, 13 Queen Square, Bristol, BS1 4NT, United Kingdom (the “Organiser”, “we”, “us”) regarding your purchase of tickets (“Ticket(s)”) to Mr Sam & The Dednutz (the “Event”) at the venue stated on the ticket page (the “Venue”).
1.2 Please also read Privacy Policy which is available at: https://freshstore.co/pages/privacy-policy and other legal guidance, which all form part of these Terms and Conditions.
1.3 If you have any queries about the Event, please contact our customer service team.
2.1 Purchase of any ticket for the Event constitutes your acceptance of these Terms and Conditions and on behalf of any person for whom you are purchasing Tickets.
2.2 Upon purchase, please check the Ticket details carefully as mistakes cannot always be rectified after purchase.
2.3 Prices and availability are subject to change without notice.
2.4 You must be at least 16 years old to attend the Event. If you are between the ages of 16 and 18, you must get a parent or guardian to approve your purchase of these Tickets. We reserve the right to refuse entry to the Event on the day if no photographic ID is provided or if the Ticket holder is underage. There may also be certain parts of the Event which are limited to 18+ attendees.
2.5 All prices for Tickets offered for sale from us are inclusive of VAT and are broken down between the sale price of the Ticket (“Sale Price”) plus any booking, transaction or supplementary fees.
2.6 Tickets may be restricted to a maximum number or sold subject to certain restrictions on entry or use (for example, it gives you access to one day of the Event only). Any such restriction shall be displayed on the website or otherwise notified to you before or at the time you book the Tickets. It is your responsibility to ensure you have read all information displayed during the purchase process. We reserve the right to cancel Tickets purchased in excess of the maximum number.
2.7 An order for Tickets is not complete until accepted by us and we have received full payment in cleared funds. We try to ensure all prices are accurate, but errors may occur. If we discover an error in the price of Tickets you have ordered we will inform you as soon as possible and we may either cancel the order (in which case you will be refunded the Ticket Sale Price and any booking, transaction or supplementary fees you have paid) or give you the option of confirming your order at the correct price.
2.8 To prevent fraud and protect us and you, our purchasing partner may carry out checks and/or you may be asked to provide additional information (such as a copy of a credit or debit card statement) after your booking so we can verify your purchase. If we suspect fraud, we may cancel any order or Tickets.
2.9 We give you a personal, limited, revocable, non-exclusive, non-transferable and non-assignable licence to use the Tickets to enter the Event. This licence is for your personal use only (so you cannot sell or otherwise transfer it to someone else) and does not give you any ownership rights in the Tickets. We own all Tickets.
3.1 You will receive a confirmation of purchase immediately. We aim to deliver your Tickets 2 weeks prior to the event. Tickets will be sent to you by email from support@freshstore.co.
3.2 You are responsible for ensuring that you provide us with a valid email address for delivery of your tickets and ensuring that you are able to receive delivery of the Tickets by email (for example by ensuring that your email mailbox does not reject, bounce or otherwise prevent any relevant emails from being delivered, and by checking your email mailbox regularly - including junk or spam folders).
4.1 Only customers holding a valid ticket will be admitted to the Event, you must retain this ticket on your person at all times during the Event or show a copy on your digital device. All Tickets are per person and need to be in the correct name. We reserve the right to request official photographic proof of ID on entry.
4.2 All advertised times are approximate and subject to change. It is your responsibility to make appropriate arrangements to ensure you arrive at the Venue in sufficient time in case the Event starts early and to ensure that you are able to stay until the close of the Event should you wish to if it overruns. Last admission to the Event will be 1 hour before the end of the Event.
4.3 Various activities may take place on one or both days of the Event (“Activities”). Your access to certain Activities will depend on what type of Ticket you have purchased. We do not take responsibility for any missed Activities due to not being present for the full duration of the Event. Appearances by Organiser talent and other talent are subject to work commitments and not all talent will appear on all days of the Event.
4.4 Individual Venue opening times and admission times are at the discretion of the Venue managers.
4.5 Ticket holders will only be allowed on site if their Ticket includes access to current Activities.
4.6 You must comply with all instructions given to you by the Organiser and/or all Venue stewards and staff at the Event. The Venue staff and/or Event staff may conduct security searches of you for safety and security purposes and/or may refuse admission to you for breaching or suspected of breaching any Terms and Conditions or Codes of Conduct of the Event or the Venue.
4.7 Admission to the Event is subject to the terms of admission of the Venue, and certain items (e.g. weaponry including sharp objects, laser pens, mobile phones, dogs (except guide dogs) and your own food and drink) may be prohibited. Please check with the Venue directly.
4.8 We reserve the right to refuse entry and/or eject those that cause disturbance or refuse to comply with reasonable requests from the Event management team. Any such persons may be removed from the Venue. If you breach these Terms and Conditions or the Event Code of Conduct, your Ticket is void.
4.9 If you have not notified the Organiser of your access requirements in advance we cannot guarantee that we will be able to cater to your needs, though we will use reasonable endeavours to do so. Please contact our customer service team if you have any access requirements.
5.1 You must observe and comply with health and safety advice, announcements and site signage where relevant. You must use designated smoking areas at the Venue if you wish to smoke and/or vape.
5.2 You must abide by the Event Code of Conduct during the Event, which is available here.
5.3 Special effects, which may include sound, audio-visual, pyrotechnic effects or lighting effects may be featured at the Event, which may not be suitable for those with photosensitive epilepsy, or similar conditions.
5.4 You must not bring into the Venue, display or distribute any sponsorship, promotional or marketing materials unless with written permission from the Organiser.
5.5 By attending the Event, you give your express consent to your actual or simulated likeness being included within any film, photograph, audio and/or audio-visual recording to be exploited in any and all media for any purpose at any time throughout the world in perpetuity, the intellectual property rights to which shall be owned by Fourth Floor or its contractors without payment or compensation.
5.6 Due to legal/artist performance rights and royalty obligations, you cannot bring any video or audio recording equipment (other than your mobile phone) or any camera which is over 40mm or with a detachable lens into the Venue. You will not be allowed to enter the Venue if you bring equipment that breaches these Terms and Conditions. Unauthorised recording equipment, recordings, tapes, films or similar items may be confiscated and destroyed or deleted.
5.7 Title, ownership and all intellectual property rights, now and in the future, of and for all photo shoot images, remain exclusively with Fourth Floor. Photo images may be available to download for personal, non-commercial use after the Event for a set fee.
6.1 Possession of a Ticket does not confer any rights on you to use, alter, copy or otherwise deal with any of the symbols, trademarks, logos and/or intellectual property appearing on the Ticket.
6.2 Your Ticket may be invalidated if any part of it is altered, removed or defaced. The Organiser will not be responsible for any Ticket that is lost, stolen or destroyed. You are solely responsible for the safe-keeping of your Ticket.
7.1 If the Event is cancelled or rescheduled, we will use reasonable endeavours to notify you. However, we cannot guarantee that you will be informed of such cancellation, rescheduling or alteration before the date of the Event. It is your responsibility to check that the Event has not been cancelled, altered or rescheduled. Information on such matters will be made available as soon as reasonably practicable on freshstore.co.
7.2 Cancellation: if the Event for which you have purchased Tickets for is cancelled in full (and not rescheduled), your Tickets will be cancelled, and you will be refunded the Sale Price of your Tickets only.
7.3 Rescheduling: if the Event for which you have purchased Tickets is rescheduled, Tickets will usually be valid for the new date (or you will be offered Tickets of a value corresponding with your original Tickets for the rescheduled Event, subject to availability). If you notify us within the specified deadline that you are unable to attend the rescheduled Event, you will be able to cancel your order and obtain a refund of the Sale Price of your Tickets. Failure to notify us within any specified deadline that you are unable to attend the rescheduled Event will be deemed to be a reconfirmation of your order for Tickets for the rescheduled Event, and you will not be able to claim a refund.
7.4 In the event of cancellation or rescheduling, the Organiser will not be responsible or liable for any costs or expenses except as outlined in section 7.2 and/or 7.3 above, including without limitation the costs of any personal travel, accommodation or hospitality arrangements made in relation to the Event.
8.1 Tickets are not exchangeable, refundable or transferable, save in the circumstances set out in section 7. You are not entitled to a refund under the Consumer Contracts Regulations 2014.
8.2 For the avoidance of doubt, this means you are not entitled to a refund where:
(a) you have purchased a Ticket and are under 16.
(b) you fail to bring an official photographic ID to the Event.
(c) delivery of your Tickets is returned, missed, rejected or fails as a result of your failure to provide correct and complete delivery information and/or failure to ensure you are available to receive delivery of Tickets.
(d) you are refused from entering or ejected from the Event for breach of these Terms and Conditions, in particular section 5.
9.1 We represent and warrant that: (i) we have the right to enter into these Terms and Conditions and to grant you the licence in section 2.9; (ii) we will take reasonable care regarding the Event and Tickets; and (iii) we will use reasonable efforts to comply with applicable laws under these Terms and Conditions.
9.2 You represent and warrant that: (i) you have the full power and ability to enter into these Terms and Conditions and will follow fully its terms; (ii) any information provided to the Organiser is true, accurate and complete and you have not and will not use any false information; and (iii) you will company with applicable laws under these Terms and Conditions.
Neither of us will be liable to the other regarding any performance, or non-performance, or delay, in whole or in part, due to Force Majeure.
“Force Majeure” means any cause preventing a party from performing any or all of its obligations which arises from or is attributable to acts, events, omissions or accidents beyond the reasonable control of the party so prevented including strikes, lock-outs or other industrial disputes (other than any such dispute involving the workforce of the party so prevented), nuclear accident or acts of God, war or terrorist activity, riot, civil commotion, malicious damage (excluding malicious damage involving the employees of the affected party or its sub-contractors), compliance with any law or governmental order, rule, regulation or direction, industrial action by employees of any providers of electrical power, failure of technical facilities, hacking, denial of service or other IT attack, deployment of IT virus malware or similar technology, fire, flood, or storm or default of suppliers or sub-contractors.
We and you both agree to make reasonable and good faith efforts to resolve any dispute between us informally. Normally we would suggest that this dispute resolution period lasts 30 days unless exceptional circumstances exist. If it is not resolved during this time, the next steps depend on where you live. If you are resident in the European Union, you may be entitled to submit a complaint through the Online Dispute Resolution Platform operated by the European Commission, details of which can be found at ec.europa.eu/consumers/odr/.
12.1 Your personal information will be collected by the Organiser and may be shared with the Venue operators and others as necessary only for the purposes of the Event. We will not otherwise share that information for marketing or any other purposes without your consent (as part of the booking process or otherwise) unless required by law. For more information, please read the Privacy Policy.
12.2 We may change these Terms and Conditions from time to time, for example to reflect changes in our services or to reflect applicable laws. If we do, we will make the changed Terms and Conditions available online and make reasonable efforts to notify you of it. It will become legally binding on you immediately after we post it online. For 30 days after the updated Terms and Conditions are posted, you are welcome to contact our customer service team if you have specific questions about the changes.
12.3 If any part of these Terms and Conditions are found not to be legally enforceable, this will not affect any other part of it.
12.4 These Terms and Conditions govern our relationship with you (and vice versa). It does not create any rights for anyone else.
12.5 Please remember that we are subject to various laws and we may be required to comply with law enforcement or other legal requirements, including import/export controls.
12.6 You and we agree that the UN Convention on Contracts for the International Sale of Goods does not apply to the Tickets or these Terms and Conditions.
12.7 We can assign, subcontract or transfer these Terms and Conditions to a third party or another member of our group if necessary for the support of the Event or Tickets, as part of any reorganisation or merger or for other business reasons. We will notify you if this happens.
12.8 No failure or delay by us or you to exercise any right or remedy provided under these Terms and Conditions or by law will constitute a waiver of that or any other right or remedy, nor will it preclude or restrict the further exercise of that or any other right or remedy. No single or partial exercise of such right or remedy by us or you will preclude or restrict the further exercise of that or any other right or remedy.
12.9 The purchase by you of tickets and these Terms and Conditions (and any contractual or non-contractual matters arising in relation to these Terms and Conditions) are governed by English law and any disputes arising out of any transaction between you and the Organiser are subject to the exclusive jurisdiction of the English Courts.
12.10 If you have a complaint in relation to the Event, please contact the Organiser promptly since complaints are very difficult to deal with after the Event. Please contact our customer service team.
